In accordance with the said statute, when bail is given, the principal is regarded as delivered to the custody of his sureties. Their dominion is a continuance of the original imprisonment. Whenever they choose to do so, they may seize him and deliver him up in their discharge; and if that cannot be done at once, they may imprison him until it can be done. They may exercise their rights in person or by agent. They may pursue him into another State; may arrest him on the Sabbath; and, if necessary, may break and enter his or another's house for that purpose. The seizure is not made by virtue of new process. None is needed. It is likened to the re arrest by the sheriff of an escaping prisoner.

The following is a summary of that fugitive's arrest.
Mike Vester of United States Fugitive Recovery Investigations and another team member located and surrounded Nick Label in a Mobile Home in Evans, CO.
Label was wanted for many charges including attempting to kill his friend whom he shot several times over money.
We received a hot lead on the suspects location. We arrived in Evans and met with the informant who had just been in the residence with the suspect ten minutes prior to our discussion. The informant did not know wheather the suspect was armed or not. The informant stated that normally he would be armed because of his business associates. The informant further stated that he had been in a high speed chase at about 3:00am that morning, the suspect had been up all night and he seemed very sketchy, nervous and tierd. The informant gave us a key to the residence and said to be very careful.
We knew that the suspect had no problem killing someone, he was wanted for attemted murder for shooting his friend several times, he was probably armed, he was probably high on drugs, so we considered the risks of going in alone and even though we wanted to personally put cuffs on this guy, we opted to go the safer route and call for police back up. We surrounded the residence so that no one could go in or out without us being aware of it and we called for back up.
Once we were able to convince the police that we were certain that we had the suspect pinned down in the mobile home, officers were dispatched. They had been looking for the suspect for a month solid, and just hours earier that morning he eluded them again.
The first of many officers arrived on scene we explained to them everything that had happened up to this point and how we were certain the suspect was inside this residence. They immediatly replaced our recovery agants at the exit points with their officers. Then the SWAT team arrived on scene, they strategecly located men all around the residence. The emergency medical and bomb squad also arrived. The car that the suspect eluded them in was recovered and an explosive device was recovered.
We were then taken into the command area where we gave our statements. Nick Label was later tear gased out of the residence without inncident.
